    DOAH (Division of Administrative Hearings)

    The state body whose administrative law judges hear disputed-fact cases against licensees and issue a recommended order to FREC.

    The Division of Administrative Hearings is an independent state body whose administrative law judges hold formal hearings when a licensee disputes the facts in an administrative complaint. The judge weighs the evidence and issues a recommended order.

    FREC then reviews the recommended order and issues the final order. FREC itself does not conduct the fact-finding hearing when the facts are disputed.

    On the exam

    Disputed facts go to a DOAH administrative law judge, who issues a recommended order. FREC issues the final order.

    Exam trap

    When the facts are disputed, the hearing is at DOAH, not at a FREC meeting. FREC decides after the judge's recommended order.
