    Variance

Permission to deviate from a specific zoning requirement because strict compliance would cause an unnecessary hardship.

A variance is approval to depart from a particular zoning rule, such as a setback or height limit, when a unique condition of the property makes strict compliance an unnecessary hardship. The owner applies to the local board of adjustment.

A variance grants narrow relief from a dimensional rule. It does not change the underlying use the zoning allows.

    On the exam

A variance grants relief from a dimensional rule for a hardship. It is not a rezoning and does not change the permitted use.

    Exam trap

A variance is not a change of use. It is narrow relief from a specific requirement because of a hardship.
